The first thing you need to know about the process for obtaining SSI or SSD benefits is that it takes time. In a best case scenario, getting approved at the initial application stage, you’re still looking at a three- to six-month wait. If your claim is denied (as most are), the process will probably take a minimum of one year (but could be longer).

So what are the basic steps in that process?

First, of course, is completing and filing the initial application. If your claim is denied, the appeals process starts with a Request for Reconsideration, followed by a hearing in front of an Administrative Law Judge (ALJ), followed by a review of your case by the Social Security Administration’s Appeals Council in Virginia. If none of those appeals are successful, you can take your case to federal court.

The Disability Evaluation Process

Before the Social Security Administration will approve a claim for SSI or SSD benefits, you need to be able to prove you have the right answers to the following five key questions:

1. Are you working? (okay as long as you are earning less than $980 a month)

2. Is your impairment severe? (must be strongly supported by objective medical evidence)

3. Does your condition meet (or equal) one of the SSA’s medical impairment listings?

4. Could you do any previous relevant work?

5. Can you do any work? (work that exists in significant numbers nationally)
