It can be frustrating trying to understand the Social Security Administration’s rules for disability claimants. It can be even more frustrating to try to get a clear answer about a rule and how it would apply in your specific situation.

My name is Michael G. Myers and as an attorney, I can help you get the SSD and SSI benefits you deserve. I also know you have questions right now and that you’ve probably already spent a fair amount of time trying to get answers. What if I can’t afford the kind of medical care I need right now? It can take time to get approved for SSI or SSD benefits. The problem is, you need medical care today but do not have the insurance or financial resources to pay for it. In Indiana, there is a Medicaid waiver program known by the name “Wishard Advantage,” which may provide the help you need right now.

Should I try to go back to work? If you think you’d like to try it, it won’t cost you the SSD cash payments and Medicare benefits you’re getting — provided that you follow the SSA’s special “work incentive” rules. Under the Ticket to Work program, people receiving SSD benefits can also get help with training and other services they need to go to work, at no cost.

How are SSD benefits calculated? SSD benefits are based on your earnings record. The formula the SSA uses also provides for yearly cost of living increases. In a typical case, the amount of benefits will be based on a worker’s average earnings for all of the years you have been working, not just your most recent salary.
